Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of the networks, systems, equipment, applications, websites, products, and services provided by Upstate IP Voice (“Upstate IP Voice,” “Company,” “we,” “us,” or “our”) (collectively, the “Services”).
This AUP applies to all customers, authorized users, and any other individuals or entities accessing or using the Services (collectively, “Users”).
By accessing or using the Services, Users agree to comply with this AUP. Upstate IP Voice reserves the right to modify this AUP at any time in its sole discretion. Continued use of the Services following any modification constitutes acceptance of the updated AUP.
1. Permitted Use
The Services are provided solely for the User’s internal business and/or personal use, as applicable, and must be used in a manner consistent with their intended purpose.
Users may not, under any circumstances:
- Resell, sublicense, lease, repackage, distribute, or commercially exploit the Services
- Provide Services to third parties without prior written authorization from Upstate IP Voice
- Use the Services as a wholesale or retail offering
2. Lawful Use Requirement
Users must use the Services in compliance with all applicable local, state, federal, and international laws and regulations.
Users may not use the Services to transmit, distribute, store, or facilitate material or activity that:
- Violates any law or regulation (including export control or encryption laws)
- Exposes Upstate IP Voice to civil or criminal liability
- Assists or enables another party to violate this AUP or applicable law
3. Prohibited Content and Activities
Users are strictly prohibited from using the Services to transmit, distribute, or store:
- Illegal, unlawful, or illicit material
- Content that infringes or misappropriates intellectual property rights, including copyrights, trademarks, patents, trade secrets, or proprietary information
- Content that violates privacy, publicity, or personal rights of others
- Malware, viruses, worms, Trojan horses, or any code intended to disrupt, damage, or compromise systems or networks
- Fraudulent, deceptive, or misleading offers, advertisements, or representations
- False or inaccurate information submitted in connection with orders, accounts, contracts, or payment methods
4. No Monitoring Obligation; Enforcement
Upstate IP Voice does not assume responsibility for content transmitted or stored through the Services and is not obligated to monitor such content.
However, Upstate IP Voice reserves the right to:
- Monitor activity where required for security, compliance, or service integrity
- Restrict, suspend, or terminate access to Services where a violation is suspected
- Remove or block access to material that violates this AUP or applicable law
- Cooperate with law enforcement or regulatory authorities, including disclosure of User information where legally required
5. Authorized Devices and Credentials
Users may only access and use the Services through devices, software, and authentication credentials authorized by Upstate IP Voice.
Users may not:
- Use unauthorized devices or software
- Share or misuse authentication credentials
- Bypass technical or security controls
- Use the Services for abnormal, excessive, or non-standard usage patterns outside normal business operations
Upstate IP Voice reserves the right to investigate abnormal usage and recover costs associated with misuse. Users authorize Upstate IP Voice to charge the payment method on file for applicable charges, damages, or fees resulting from misuse, to the extent permitted by law.
6. Messaging, Email, and Anti-Spam Policy
Users may not use the Services to send or facilitate unsolicited communications, including but not limited to:
- Spam, bulk unsolicited messages, or mass marketing without consent
- Harassing, abusive, or excessive communications
- Messages sent after a recipient has requested cessation
- Messages with forged headers or misleading routing information
- Malicious communications such as mail bombing or denial-of-service messaging
Users are also prohibited from using third-party services to promote content or services hosted on or connected to Upstate IP Voice in violation of this AUP.
7. Third-Party Platforms and Communities
Users may access third-party platforms, forums, or services through the Services. Users are responsible for complying with all applicable third-party rules, charters, and acceptable use policies.
Users may not:
- Engage in excessive posting, cross-posting, or message flooding
- Impersonate moderators or administrators
- Post forged or misleading technical information
- Harass or annoy other users
8. Security Violations
Users are strictly prohibited from attempting to violate or circumvent the security of the Services, including but not limited to:
- Unauthorized access to data, accounts, or systems
- Impersonation of Upstate IP Voice personnel
- Probing, scanning, or testing system vulnerabilities without authorization
- Interfering with or disrupting networks, hosts, or services
- Forging packet headers or technical identifiers
- Attempting to evade billing or usage measurement mechanisms
Security violations may result in immediate suspension or termination and may lead to civil or criminal liability. Upstate IP Voice may cooperate fully with law enforcement authorities.
9. Suspension and Termination
Upstate IP Voice may suspend or terminate access to the Services immediately, without notice, if a User violates this AUP, applicable law, or poses a risk to service integrity, security, or other Users.
10. No Waiver
Failure by Upstate IP Voice to enforce any provision of this AUP shall not constitute a waiver of future enforcement.
